This standard defines the requirements for reporting nonconforming material, including Suspect Counterfeit or Counterfeit (S/C) items to GIDEP, and using such information from GIDEP to prevent the use of such items. The Government-Industry Data Exchange Program (GIDEP) is a program that allows organizations to report common items with major and critical nonconformances, including suspect counterfeit or counterfeit items (herein referred to as S/C items). GIDEP members use GIDEP data and information to prevent the infiltration of major and critical nonconforming material including counterfeits into industry and government supply chains and products. This standard defines the uniform requirements and practices that organizations follow when using GIDEP, as required when United States Federal Acquisition Regulation, FAR 52.246-26, or Defense Federal Acquisition Regulation Supplement, DFARS 252.246-7007, are invoked in contracts. FAR 52.246-26 is applicable to both critical/major nonconformances and Suspect Counterfeit or Counterfeit (S/C), while DFARS 252.246-7007 is applicable to counterfeit (S/C) electronics parts and assemblies containing such parts. Additionally, this document describes the requirements of FAR 52.246-26 and DFARS 252.246-7007 using discussion and examples to enhance the user’s understanding of how the regulations apply to GIDEP. One concept that is central to the reporting to and use of GIDEP is that GIDEP contains reports about commonly available items including, but not limited to, Commercial Off-the-Shelf (COTS). It is critical that all nonconforming or S/C items (commercial and/or military) be reported to GIDEP to prevent continued procurement and usage. There are five basic requirements of FAR 52.246-26: (1) screening existing GIDEP reports; (2) notifying the Contracting Officer if S/C items are discovered; (3) retaining S/C items; (4) reporting to GIDEP major or critical nonconforming items, or S/C items; and (5) applying these requirements to appropriate subcontracts. These requirements apply when FAR 52.246-26 is invoked in the contract. There will be circumstances where the organization subcontracts for commercial items. This subcontract is exempt from flow-down of FAR 52.246-26, but the commercial items received by the organization from the subcontractor are covered by the FAR 52.246-26(b)(4), which is the requirement to submit a report to GIDEP.
